Terms of Service
Please read these terms carefully before accessing or using Credit Consultant services.
Credit Consultant is an independent financial technology and credit advisory service platform. Credit Consultant is NOT a Credit Information Company (Credit Bureau), NOT an RBI-regulated lending entity, and DOES NOT lend money. We do not compute, modify, or maintain official bureau records on our own authority, nor do we guarantee any credit score increment or loan approval. All credit scores are generated independently by RBI-licensed bureaus (TransUnion CIBIL, Experian India, Equifax India, CRIF High Mark).
Agreement, Legal Entity & Acceptance of Terms
These Terms of Service ("Terms", "Agreement") constitute a legally binding electronic contract between you (the "User", "Subscriber", "You") and Credit Consultant (together with its operators, affiliates, and technology successors, "Company", "We", "Us", "Our"), governing your access to and use of our web portal, mobile interfaces, software applications, APIs, and credit advisory services (collectively, the "Platform").
This document is an electronic record generated by a computer system under the Information Technology Act, 2000 and the rules thereunder, as amended, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This Agreement does not require any physical or digital signature.
By clicking "Sign In to Dashboard", "Verify OTP", "Confirm & Continue", submitting payment, or otherwise accessing our Platform, you acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms and our companion Privacy Policy. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Platform.
Eligibility, Account Verification & User Representations
To register, create an account, or access credit reports on the Platform, you represent and warrant that:
- You are an individual residing in the Republic of India who is at least 18 (eighteen) years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872.
- The 10-digit Indian mobile number provided during registration is registered in your personal name with your telecom service provider.
- All identification information, including your full legal name, Date of Birth (DOB), gender, and Permanent Account Number (PAN), is accurate, current, and belongs exclusively to you.
- You are registering for yourself and not on behalf of any other individual, minor, entity, or fictitious identity.
Description & Limitations of Platform Services
The Platform provides a specialized credit analytical suite and advisory facilitation service, comprising:
Retrieving Credit Information Reports (CIR) from authorized Credit Information Companies (TransUnion CIBIL, Experian India, Equifax India, and CRIF High Mark) pursuant to user authorization, providing dashboard metrics, credit mix calculation, and downloadable reports.
Assisting subscribers in identifying mismatches, incorrect DPD markers, duplicate records, or outdated settled remarks, and facilitating online dispute creation and document uploads pursuant to Section 21 of the Credit Information Companies (Regulation) Act, 2005.
Platform Roles: The Platform supports distinct user accounts: Subscribers (end customers managing personal credit information), Agents (certified credit advisory representatives handling customer consultation and dispute workflows), and Administrators (system personnel managing platform security, compliance, and user records).
Statutory Consent & Credit Information Bureau Authorization
By initiating registration, validating your mobile via One-Time Password (OTP), or opting to refresh a report, you expressly appoint Credit Consultant as your authorized representative to execute the following actions under the Credit Information Companies (Regulation) Act, 2005 (CICRA 2005), the CIC Rules, 2006, and the Digital Personal Data Protection Act, 2023:
- Appointment as Agent: You expressly authorize Credit Consultant, acting on your behalf, to request, retrieve, receive, and access your credit information, credit scores, account histories, and related demographic data from TransUnion CIBIL Limited, Experian Credit Information Company of India Private Limited, Equifax Credit Information Services Private Limited, and CRIF High Mark Credit Information Services Private Limited.
- Mobile-to-Details Prefill Authorization: You confirm providing informed, unconditional, and unwithdrawn consent for our automated prefill service to verify your mobile number against credit database registries to populate your name, PAN, date of birth, and associated address records for validation.
- Data Processing & Storage: You authorize Credit Consultant to securely decode, parse, cache, and persist your credit report data within our encrypted infrastructure for the purpose of presenting your analytics dashboard, generating PDF records, and assessing dispute eligibility during your active subscription period.
Subscription Plans, Refresh Credits, Payment Terms & Strictly No-Refund Policy
Access to full credit reports, multi-bureau analytics, and dispute submission is subject to the purchase of dynamic subscription plans displayed on our Platform (payable via Razorpay in Indian Rupees inclusive of applicable Goods and Services Tax):
- Refresh Credits: Each subscription package grants an allotted quota of "Refresh Credits". Triggering a fresh bureau fetch from the dashboard or batch selector deducts exactly 1 (one) credit from your balance in an atomic transaction.
- Instant Digital Delivery: All services provided on Credit Consultant are digital information services fulfilled instantaneously. Upon successful payment authorization, the Platform communicates directly with external credit bureau APIs and generates your report immediately.
Because Credit Consultant incurs immediate, non-recoverable third-party API licensing costs with Credit Information Companies (CIBIL, Experian, Equifax, CRIF) the moment an order is placed: ALL SUBSCRIPTION FEES, PLAN PURCHASES, AND REFRESH FEES ARE 100% FINAL, NON-REFUNDABLE, AND NON-CANCELLABLE. We do not offer cash refunds, partial refunds, or credit notes under any circumstances once report processing has commenced or refresh credits have been credited to your account.
Failed Transactions: If your bank account or payment card is debited but the Razorpay payment status does not reach "captured" on our Platform due to a network interruption or bank timeout, the deducted sum will be refunded automatically by your issuing bank and the Razorpay gateway back to the source account within 5 to 7 banking business days in accordance with standard RBI electronic settlement guidelines.
Credit Rectification Assistance & Supporting Document Uploads
Subscribers may initiate formal dispute cases via our Rectification Wizard (/dashboard/disputes/create) to challenge reporting inaccuracies across credit bureaus. In connection with dispute cases:
- Supporting Documentation: You agree to provide genuine, un-manipulated supporting documentation (such as formal bank No-Dues Certificates, foreclosure receipts, bank statement excerpts, or settlement agreements). You acknowledge that uploading forged, altered, or falsified financial records is an actionable offense.
- Lender & Bureau Adjudication: Credit Consultant acts solely as an advisory and procedural facilitator. The statutory legal obligation to verify, amend, or close a disputed loan record rests exclusively with the reporting Member Credit Institution (Bank/NBFC) and the Credit Bureau pursuant to Section 21 of CICRA 2005. Credit Consultant cannot forcibly alter a bank's ledger or compel a bureau to delete valid historical default entries.
Prohibited Conduct, Security Controls & Account Suspension
You agree not to engage in any of the following unauthorized activities:
- Accessing or attempting to access credit files belonging to any third party without written legal authorization.
- Employing automated scrapers, crawlers, scripts, bots, or extraction engines to harvest reports or database contents.
- Attempting to bypass One-Time Password (OTP) verification routines, flood authentication endpoints, or interfere with security rate-limiting mechanisms.
- Uploading files containing malware, trojans, malicious script payloads, or deceptive file formats into document upload forms.
- Decompiling, reverse engineering, or disassembling any software component, scoring algorithm, or layout of the Platform.
Automated Security Lockouts: The Platform actively enforces rate-limiting and lockout middleware (login.security). Repeated failed OTP entries or unauthorized API requests will trigger automated account lockouts and IP blacklisting to safeguard customer records.
Disclaimers, Third-Party Dependencies & Limitation of Liability
"As Is" and "As Available": The Platform, including all analytics, credit scores, summary accounts, and PDF downloads, is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, whether express, statutory, or implied.
Bureau Accuracy & Availability: Credit Consultant has no ownership over bureau databases. Bureau score calculations, reporting delays, or inaccuracies introduced by banking institutions are not the responsibility of Credit Consultant. We are not liable for transient API failures or maintenance downtimes of third-party bureau servers.
Financial Decisions: Any financial decision, loan application, debt settlement, or credit card request you undertake based on analytics viewed on our Platform is solely at your own risk. Credit Consultant does not provide investment, legal, or formal lending advice.
Limitation of Monetary Liability: TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE INDIAN LAW, IN NO EVENT SHALL CREDIT CONSULTANT, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL DAMAGE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM. THE TOTAL AGGREGATE LIABILITY OF CREDIT CONSULTANT FOR ANY AND ALL CLAIMS ARISING UNDER THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR YOUR CURRENT SUBSCRIPTION PLAN IN THE IMMEDIATELY PRECEDING 3 (THREE) MONTHS.
Grievance Redressal, Governing Law & Dispute Resolution
Governing Law: This Agreement and any dispute or claim arising out of or related to your use of the Platform shall be governed by, construed, and enforced exclusively in accordance with the laws of the Republic of India, without giving effect to conflict of laws principles.
Dispute Resolution & Arbitration: In the event of any controversy, claim, or dispute arising out of or relating to these Terms, the parties shall first endeavor to settle the dispute amicably through good-faith mutual negotiations within 30 (thirty) days. If unresolved, the dispute shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by Credit Consultant. The seat and venue of arbitration shall be New Delhi / Jaipur, India, and the arbitration proceedings shall be conducted in the English language. Subject to arbitration, the courts of competent jurisdiction in India shall have exclusive jurisdiction.
